Terms and Conditions

1. Definitions

  • "We," "Our," "Us": Refers to Aspect Prints.

  • "You," "Your": Refers to the Buyer, whether an individual or a business.

  • "Artwork": The art piece being sold, also referred to as the "product."

  • "Business Buyer": A corporate entity, sole trader, or partnership purchasing for purposes related to their business, craft, or profession.

  • "Individual Buyer": A natural person buying for personal use, protected by consumer rights legislation.

  • "Order": Any purchase of Artwork made through our website or a written request.

  • "Contract": The agreement for the sale of goods, consisting of these terms, the product description on the website, and the order confirmation or invoice.

  • "Collection": The point at which you or your agent takes possession of the Artwork. Risk of damage passes to you at this point.

  • "Total Cost": The full price of the Artwork, including shipping, insurance, and any other agreed-upon fees.

2. Acceptance of Terms

By making any inquiry or purchase, you confirm you are at least 18 years old and agree to be bound by these terms. We may update these terms at our discretion, and the version in effect at the time of your order will apply.

3. Placing an Order

The display of Artwork on our website is an "invitation to treat," not a legally binding offer. A Contract is formed when you complete a purchase on our website or confirm your acceptance of a written invoice. We reserve the right to refuse a sale for any reason.

4. Payments and Invoicing

Full payment is required before any Artwork is shipped or made available for collection. Invoices must be paid in full within 7 days unless otherwise agreed upon in writing. You are responsible for any bank transfer fees. We may charge interest on late payments. For sales of €10,000 or more, we are legally required to perform anti-money laundering checks, which may require you to provide identification and proof of address.

5. Shipping and Collection

You are responsible for all Disbursements (shipping and insurance costs). We will arrange shipping and insurance unless you opt to handle this yourself. We are not liable for any damage or loss that occurs after the risk has passed to you upon Collection or delivery. We will not undervalue artwork for customs purposes. Title to the Artwork passes to you only after full payment is received.

6. Returns and Refunds

  • Individual Buyers: You have the right to cancel your order and return the Artwork within 14 days of taking delivery for a full refund of the product price. You are responsible for the cost of returning the item. A refund will be processed within 14 days of us receiving the returned Artwork, provided it is in its original condition.

  • Business Buyers: Returns are not accepted unless the Artwork is damaged upon receipt, inauthentic, or does not match the product description.

7. Reporting Damage or Inauthenticity

You must inspect the Artwork and report any damage to us within 5 working days of delivery. To report inauthenticity, you must hire a certified art appraiser to validate your claim. Any claims of inauthenticity must be made within 12 months of the contract date. After this period, we are not liable for such claims.

8. Limitation of Liability

We sell Artwork on an "as is" basis. Our liability is limited to the Net Sale Price of the Artwork and we are not responsible for any indirect or consequential loss, such as loss of profit. We do not provide any warranty regarding the Artwork's future investment potential or market value. We are not liable for any delays or failures in performance due to events outside our control (force majeure).

9. Intellectual Property and Buyer Obligations

All intellectual property, including our name, logo, and website content, belongs to Aspect Prints. You may not use, copy, or distribute our intellectual property without our written permission. You agree not to circumvent us to directly engage with any seller or consignor we have introduced you to. You must provide accurate information for delivery and due diligence checks.

10. Governing Law

These terms are governed by English law, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
